Since 1 January 2026, all crypto service providers in Europe are required to pass on information about their customers and transactions to the tax authorities. This is set out in a European directive called DAC8. Below we explain what this means for you.
What is DAC8?
DAC8 is a European directive (EU 2023/2226) on the automatic exchange of tax information about crypto. Crypto service providers, such as BTC Direct, collect information about their customers and transactions every year and report it to the tax authority of their country. For BTC Direct, this is the Dutch Tax Administration (Belastingdienst). It then exchanges this information with the tax authorities of other countries. DAC8 is aligned with the OECD's Crypto-Asset Reporting Framework (CARF), which also allows information to be exchanged with countries outside the EU.
The aim is greater transparency and preventing tax evasion involving crypto.
Does this only apply to BTC Direct?
No. DAC8 applies to all crypto service providers in the EU, such as exchanges, brokers and wallet providers. Providers outside the EU that offer services to customers in the EU may also be covered. This means other providers will also ask for your details and pass them on to a tax authority. Switching to another provider does not change this.
Since when does it apply?
- The rules apply to transactions from 1 January 2026. Transactions before 2026 are not covered by the new reporting obligation.
- The first report covers calendar year 2026 and will be submitted to the Dutch Tax Administration by 31 January 2027 at the latest.
- After that, we report every year on the previous calendar year.
Which information does BTC Direct ask for and report?
About you as a customer
- name and address
- country of residence (tax residence) and tax identification number (TIN). In the Netherlands, this is your BSN
- date of birth, country of birth and, where required, place of birth
- for businesses: details of the company and its ultimate beneficial owners (UBOs)
About your transactions
- which cryptocurrencies you bought, sold or sent
- the amounts and value of those transactions, per calendar year
If we do not yet have this information, we will ask for it when you create your account or after you complete an order.
Why do you ask for my BSN?
Your BSN is your tax identification number (TIN) in the Netherlands. The Dutch Tax Administration uses it to link the report to you. We only use it to comply with our legal obligation.
I am also tax resident in another country. What do I fill in?
At the "Tax residence" step, enter all countries where you are tax resident, and your TIN for each. If a country does not issue a TIN, indicate this as the form instructs. Not sure which number to enter? Ask the tax authority of that country or your tax adviser.
What do you do with my information?
We only use your information to comply with DAC8 and other legal obligations. It is stored securely, not used for marketing and only shared with the Dutch Tax Administration. We comply with the GDPR. Would you like to view or correct your information? You can do so via our privacy statement.
Do I still need to file my own tax return?
Yes. DAC8 does not change your own responsibility. You remain responsible for correctly declaring your crypto, even if the tax authorities receive information from us. BTC Direct does not give personal tax advice. If you have questions about how to declare your crypto, please contact your tax authority or a tax adviser.
Frequently asked questions
Does BTC Direct inform the tax authorities?
Yes. From 2026, we are legally required to report information about customers and transactions to the Dutch Tax Administration every year. The first report follows in January 2027, covering 2026.
Do other crypto providers report this too?
Yes. All crypto providers in the EU, and providers outside the EU that serve customers in the EU, must collect and report information about their customers. It applies to everyone, not just us.
Are my purchases from 2025 covered?
No. DAC8 applies to transactions from 1 January 2026.
I want to change my tax details (residence or TIN). How do I do that?
You can do this in MyBTC at the "Tax residence" step.
Do I have to provide this information?
We are legally required to collect this information. If you have questions or objections, please contact our customer service.
I received an email from BTC Direct about DAC8. Is it genuine?
We email customers asking them to complete their tax details (DAC8). This email comes from a BTC Direct email address (@btcdirect.eu) and the link in the email leads to my.btcdirect.eu/en-gb/dac8. Not sure? Do not click the link, but type the address into your browser yourself. You can also contact our customer service.
Why do I have to complete the form via a link and not in my account?
Not all customers have their own login with us, for example if you registered through a partner. The link allows everyone to complete the form, even without logging in. The form is hosted on our own environment (my.btcdirect.eu).
I cannot find the form in my account. What now?
At the moment, the form is not available in your account menu. You can open it via the link in our email, or by pasting my.btcdirect.eu/en-gb/dac8 into the address bar of your browser.
Where can I find official information?
On the website of the Dutch Tax Administration. Search for "DAC8" or "CARF".
